Terms of Service

By participating in the yacht charter, cruise, excursions, activities, travel, conferences, water sports, hiking and/or other events organized by Mastermind Adventures LLC and/or its affiliated entities, contractors, vendors, executives, shareholders or individuals (collectively referred to as "Company"), you agree to the following terms and conditions:

1. Agreement to Follow Directions: You agree to observe and obey all posted rules, warnings, and instructions provided by the Company, its staff, crew, employees, representatives, and agents during all activities. Failure to follow directions may result in removal from activities without refund.

2. Assumption of Risks and Release of Liability: Participation in the Company’s events involves inherent risks, including but not limited to physical injury, illness, property damage, or financial loss. By participating, you agree to:

Assume full responsibility for any risks, injuries, or damages arising from your participation.Release and discharge the Company, its employees, agents, and affiliates from any liability, claims, or demands for damages related to injuries, losses, or damages of any kind, whether caused by negligence or otherwise.

3. Release of Liability for Personal Property: You agree that the Company is not responsible for the loss, theft, or damage of personal property brought to any event, including on the yacht or during activities. Please take appropriate precautions to safeguard your belongings.

4. Indemnification: You agree to indemnify, defend, and hold harmless the Company from any claims, damages, losses, or expenses (including attorney fees) arising from your actions, omissions, or participation in the event.

5. Responsibility for Damages: You are responsible for any damage to the property, facilities, or equipment of the Company caused by your actions or those of your guests.

6. Acknowledgment of Fitness and Health: By participating, you confirm that you are physically fit and able to participate in the planned activities. You agree to notify the Company in advance of any medical conditions, allergies, or limitations that may affect your ability to participate. Participation is at your own risk.

7. Insurance: The Company does not provide personal insurance coverage for participants. It is your responsibility to obtain appropriate travel, health, or liability insurance to cover unforeseen circumstances, cancellations, or emergencies.

8. Use of Testimonials, Photos, and Videos: By participating, you grant the Company permission to use any photographs, videos, testimonials, or recordings of you taken during the event for marketing, advertising, or promotional purposes. This includes use on the Company’s website, social media, and printed materials. No compensation will be provided for such use.

9. Applicable Law: These terms and conditions are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

10. Dispute Resolution: The parties will attempt to resolve disputes through friendly negotiation. If unresolved, disputes will be submitted to mediation. If mediation fails, disputes will be resolved through binding arbitration in accordance with the commercial rules of the American Arbitration Association. The arbitrator’s decision will be final and binding.

11. No Refunds or Changes: Due to the nature of this event, no refunds or changes are permitted. All bookings are final, and the event will proceed as planned barring extraordinary circumstances. Any changes to schedules, itineraries, or activities will be made at the discretion of the Company and are subject to change without notice.

12. Privacy Policy: The Company respects your privacy and is committed to protecting your personal information. Any information collected during registration or participation (e.g., name, contact information) will be used solely for event coordination and marketing purposes as described in these terms. Your data will not be sold or shared with third parties without your consent, except as required by law.

13. Acknowledgment and Acceptance: By participating in the event, you acknowledge that:

14. Miscellaneous:

These events are intended as a shared adventure among like-minded individuals, not a typical customer/business relationship. Think of this as friends coming together for a once-in-a-lifetime experience.The Company reserves the right to update these Terms of Service as necessary.
